LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK

By registering for, purchasing, attending, or participating in any Christopher Howard Golf school, lesson, clinic, event, program, or related activity (“Golf Activities”), you acknowledge and agree to the following terms.

Assumption of Risk

Golf and activities occurring on or around a golf course involve inherent and other risks. These risks may include, but are not limited to:

  • Being struck by golf balls, golf clubs, golf carts, equipment, or other objects;

  • Slips, trips, and falls;

  • Uneven, wet, slippery, or otherwise hazardous terrain;

  • Golf cart accidents or injuries;

  • Inclement or changing weather conditions, including heat, cold, rain, wind, and lightning;

  • Physical exertion, fatigue, or aggravation of an existing condition;

  • Actions or negligence of other golfers, participants, spectators, course personnel, or third parties;

  • Wildlife, insects, plants, water hazards, and other natural conditions; and

  • Other risks ordinarily associated with golf courses, golf instruction, travel, and outdoor recreational activities.

You understand that Christopher Howard Golf cannot eliminate or guarantee protection from all risks associated with participation.

By choosing to participate, you knowingly and voluntarily accept and assume the risks associated with the Golf Activities.

Release and Waiver of Liability

To the fullest extent permitted by applicable law, you release, waive, and discharge Christopher Howard Golf and its owners, officers, instructors, employees, contractors, agents, representatives, affiliates, successors, and assigns from claims, demands, actions, damages, losses, expenses, or liabilities arising out of or relating to your participation in Golf Activities.

This release is intended to apply to claims arising from the ordinary negligence of the released parties to the extent such claims may legally be waived.

Nothing in this waiver is intended to waive or limit any right or liability that cannot lawfully be waived or limited.

Golf Courses and Third-Party Facilities

Christopher Howard Golf conducts schools and other activities at independently owned and operated golf courses, resorts, practice facilities, and other venues.

Unless expressly stated otherwise, these facilities are not owned, operated, or controlled by Christopher Howard Golf.

You agree to comply with all rules, policies, safety requirements, dress codes, and instructions established by the applicable facility.

To the fullest extent permitted by law, Christopher Howard Golf is not responsible for the acts or omissions of independently owned golf courses, facilities, transportation providers, hotels, vendors, or other third parties.

Personal Responsibility

You are responsible for determining whether you are physically capable of participating safely in Golf Activities.

You are responsible for your own conduct, equipment, personal belongings, transportation, and compliance with applicable course and facility rules.

If you believe a condition or activity is unsafe, you should discontinue participation and notify an instructor or facility representative.

Medical Treatment

In the event of an injury or medical emergency, you authorize Christopher Howard Golf personnel or representatives to contact emergency medical services when reasonably necessary.

Christopher Howard Golf does not provide medical care and does not guarantee the availability or outcome of emergency treatment.

You are responsible for medical expenses incurred as a result of your participation unless otherwise required by applicable law.

Personal Property

Christopher Howard Golf is not responsible for lost, stolen, misplaced, or damaged personal property, including golf clubs, equipment, electronics, clothing, luggage, or other belongings, except where responsibility cannot legally be excluded.

Participants Under 18

A parent or legal guardian must register for and consent to participation on behalf of any participant under the age of 18.

The parent or legal guardian acknowledges the risks associated with the minor’s participation and agrees to the applicable terms of this waiver to the fullest extent permitted by law.

Acknowledgment

By purchasing, registering for, attending, or participating in a Christopher Howard Golf program, you acknowledge that you have read and understand this Liability Waiver, Release & Assumption of Risk and voluntarily agree to its terms.

If registration or checkout includes an acknowledgment checkbox, electronic acceptance of that checkbox constitutes your acknowledgment and agreement to these terms.

Applicable Law

The enforceability and interpretation of this waiver are subject to applicable federal, state, and local laws. If any provision is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
